The Department of Agriculture External Team Site Signup Terms and Conditions


Background

External Team Sites are available to Department of Agriculture staff both in Central Office and Regional areas and to their stakeholders and clients, both within the Department and externally within industry.

The Department of Agriculture External Team Sites are an online team collaboration application developed on the Microsoft SharePoint platform and is a web browser based product. Users are given a web page address to access the Department of Agriculture External Team Site login screen. The Department of Agriculture External Team Sites have the ability to provide multiple environments allowing the participants to work collaboratively, share documents, conduct discussions and manage meetings via calendaring functionality.

To post messages to these External Team Sites, you must register as a user via the relevant External Team Site Administrator. This registration is free of charge. By registering, you agree to abide by the following Terms and Conditions. You should read these Terms and Conditions carefully:

Definitions and Interpretation

  1. External Team Sites’ means the online team collaboration applications, developed on the Microsoft SharePoint platform as a web browser based product, and being made available by the Department of Agriculture to users who agree to these Terms and Conditions.

  2. 'External Team Site Administrator' means the Department of Agriculture employee notified to you, that is responsible for the relevant External Team Site(s) you have access to.

  3. If any provision of these Terms and Conditions are invalid or not enforceable in accordance with their terms, you agree that other provisions which are self-sustaining and capable of separate enforcement with regard to the invalid or unenforceable provision are, and continue to be, valid and enforceable in accordance with their terms.

  4. These Terms and Conditions are to be construed in accordance with the laws of the Australian Capital Territory. You agree to submit to the non exclusive jurisdiction of the courts of the Australian Capital Territory and the Federal Court of Australia.

  5. General Conditions for Use of External Team Sites:

  6. You acknowledge that you have read, understood and accepted both the Privacy Statement (http://www.daff.gov.au/about/privacy) and Disclaimer (http://www.daff.gov.au/about/disclaimer).

  7. You acknowledge that all your activities on the External Team Sites may be tracked for auditing purposes.

  8. You must not permit any other person to use your account or password and must ensure that you keep your password confidential at all times.

  9. You must not use anyone else’s password.

  10. Team Sites can be used to store documents classified up to In-Confidence. You must not use an External Team Site to store or transmit any information above In-Confidence. (This includes Cabinet-In-Confidence material, which must be handled at least at the same level as Protected information.)

  11. You must not post any information on the External Team Sites that may be used to identify a person who is not a user, unless that person has consented to the posting. For example, you must not post the names, addresses, telephone numbers, email addresses, photographs, or other identifying information of people who are not users unless that person has consented to such use (either expressly or by their conduct).

  12. You must only access documents stored in the External Team Sites or upload documents to the External Team Site for the purpose of enabling the members of the External Team Site to share information in an on-line collaborative environment. You must not make Information which you have obtained from an External Team Site available to other persons who are not registered users of the External Team Site.

  13. You acknowledge that the Department of Agriculture has taken all reasonable security measures to harden the external server where documents on the External Team Sites are stored, but does not guarantee protection from individuals who may try to circumvent these measures.

  14. You acknowledge that the Department of Agriculture or the External Team Site Administrator may at their own discretion, bar registration to the External Team Site from any specific e-mail service or ISP.

  15. You acknowledge that the Department of Agriculture has the ability to edit and/or remove objectionable messages. Any user who believes that a posted message is objectionable should contact the Department of Agriculture immediately by e-mail to internet.team@daff.gov.au.

  16. You acknowledge that by posting material on the External Team Site/s, some of your personal information (such as your name and e-mail address, and any other personal information you include in your posting) may be made public. The Department of Agriculture does not guarantee the anonymity of any personal information you post to the External Team Site/s and you consent to the Department of Agriculture disclosing such information to any other users or for its internal purposes.

  17. To the extent permitted by applicable laws, in relation to material you have posted on the External Team Sites you consent to:

    1. any failure by the Department of Agriculture or other users to identify authorship of the material;

    2. any incorrect identification by the Department of Agriculture or other users of the authorship of the material to you or anyone else; and

    3. any action by the Department of Agriculture or other users that materially alters the content, format, colours, layout or style of any material, or adds any additional content or information to any material.

  18. You acknowledge that the Department of Agriculture may at any time, revise or update these Terms and Conditions. You agree that your continued use of the External Team Site/s after a variation of the Terms and Conditions will constitute your consent to, and acknowledgement that you will comply with, the amended Terms and Conditions.

  19. APS Employees Additional Acknowledgements

  20. If you are a Department of Agriculture employee, you must comply with the Department of Agriculture's Email and Internet Code of Conduct when using the External Team Sites. Information posted to the External Team Sites should be treated in the same way as email communications.

  21. Under the Email and Internet Code of Conduct:

    1. The Department of Agriculture Employees are legally and personally responsible and accountable when using departmental facilities and may be charged the full cost of any usage that is considered to be excessive or inappropriate. They may also be held accountable for any business disruption (eg through introducing a virus) resulting from non-departmental activity; and

    2. Departmental telecommunication facilities are only to be used in accordance with the law, the APS Code of Conduct and Values (under the Public Service Act 1999 (Cth)) and the Department of Agriculture's values and policies relating to offensive behaviour.

  22. If you are an employee of another APS agency, you must comply with that agency’s email and internet usage policies, as well as the APS Code of Conduct and Values (under the Public Service Act 1999 (Cth)). You acknowledge that inappropriate usage of the External Team Sites will be reported to the relevant agency head and action may be taken in accordance with the APS Code of Conduct and Values and that agency's internet and email usage policies.

  23. Non APS Employees Additional Requirements for Use

  24. If you are not an APS employee under the Public Service Act 1999 (Cth):

    1. you acknowledge and agree that to the maximum extent permitted by law, the Department of Agriculture and the Commonwealth Government:

      1. makes no representations or warranties express or implied in relation to the download, installation, operation, upload or effectiveness of the External Team Sites or any software used to access or operate the External Team Sites, including interaction and compatibility with other aspects of your computer system; and
      2. will not be liable in any way for any loss or damage whatsoever that you may incur arising from or in connection with the External Team Sites or any software used to access or operate the External Team Sites, or their download, installation, use or performance;

    2. you acknowledge and agree that any message posted on the External Team Sites expresses only the views of the author of the message and is in no way intended to reflect the views of the Department of Agriculture, the Commonwealth Government, or any person or entity associated with them;

    3. you acknowledge that the External Team Sites use moderators and administrators to monitor the content and appearance of messages posted in the External Team Sites. However, considering the real-time nature of these postings, it is impossible for the administrators to monitor or review every message. Therefore, you acknowledge and agree that neither the Department of Agriculture, the Commonwealth Government, or any person or entity associated with them, will be held responsible for the contents, accuracy, completeness or validity of any information posted on the External Team Sites;

    4. you must not use the External Team Sites to post any material, or links to any material, which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise in violation of any law;

    5. by posting material to the External Team Sites you grant the Department of Agriculture and all other users of the External Team Sites a non-exclusive, perpetual, world wide licence (including the right to sublicense) to use, copy, adapt, modify, publish, communicate and otherwise exploit the copyright in the material published;

    6. you warrant that you will not infringe the intellectual property rights (such as copyright or trade marks) of any third party by posting material on any of the External Team Sites. You agree that you will not post on the External Team Sites any copyrighted material without the express permission of the copyright holder, unless such copyright is owned by you or is licensed to you. You warrant that neither the Department of Agriculture, the Commonwealth Government, or any person or entity associated with them, will breach the intellectual property rights of a third party by using the posted material for the purposes of the External Team Site or for any other purposes;

    7. except in relation to the Commonwealth's rights to restrain publication and use of security classified material, you acknowledge that information posted by you on this site is not posted on the condition that it remain confidential and you consent to any future disclosure of such information by the Department of Agriculture, the Commonwealth Government, or any person or entity associated with them; and

    8. you acknowledge and agree that the Department of Agriculture reserves the right to remove content placed on the Team Sites at its discretion. You agree that you are solely responsible for the content of any messages or other material posted to the Team Sites. You agree that you will indemnify the Department of Agriculture, the Team Site/s Administrators, and their agents and employees for any loss, damage, costs or expense suffered or incurred by any of those parties (including third party losses and legal expenses on a full indemnity basis), caused by or as a result of:

      1. the appearance or transmission of any material that you up-load on to the Team Site/s;
      2. your use of the Team Sites;
      3. any breach of contract; or
      4. any other negligent act in relation to your use of the Team Site/s.

Background

External Team Sites are available to Department of Agriculture staff and their stakeholders. Definitions

'External Team Site Administrator' means the Department of Agriculture employee responsible for the External Team Sites you have access to.

External Team Sites’ means the online team collaboration application developed on the Microsoft SharePoint platform as a web browser based product, and made available to users who agree to these Terms and Conditions.

Intellectual Property Rights’ means all intellectual property rights, including copyright, patents, trademarks, designs, trade secrets, know how, rights in circuit layouts, domain names and any right to have confidential information kept confidential, as well as any application or right to apply for registration of any such intellectual property right, and all rights of a similar nature, whether or not such rights are registered or capable of being registered.

Personal Information’ has the same meaning as given in the Privacy Act 1988 (Cth) as amended from time to time.

The Commonwealth’ means the Commonwealth of Australia, including but not limited to its departments, ministers, employees, servants and agents

Conditions for Use of External Team Sites:

  1. You acknowledge that:
    1. you have read, understood and accepted both the Department of Agriculture’s Privacy Statement (http://www.daff.gov.au/about/privacy) and Disclaimer (http://www.daff.gov.au/about/disclaimer).
    2. your activities on External Team Sites may be tracked and recorded.
    3. you are solely responsible for the content of any material posted to External Team Sites.
    4. any message posted on External Team Sites expresses only the views of the author of the message.
    5. the Department of Agriculture does not guarantee that the information you provide during your user registration, or when posting information to External Team Sites, is protected from malicious or improper attempts to access the information
    6. the Department of Agriculture may, at its discretion and without notice, refuse or cancel the registration of any user or block the access of any IP address.
    7. the Department of Agriculture may edit and/or remove objectionable messages. Any user who believes that a posted message is objectionable should contact the Department of Agriculture by e-mail to internet.team@daff.gov.au.
    8. Department of Agriculture staff may access material on External Team Sites and disseminate it internally.
    9. the Department of Agriculture may at any time update these Terms and Conditions. You agree that your continued use of External Team Sites after a variation will constitute your consent to the amended Terms and Conditions.
  2. You understand that you must not:
    1. permit another person to use your registered account or use anyone else’s account to access an External Team Site.
    2. make information which you have obtained from an External Team Site available to anyone who is not a registered user.
    3. deal with Personal Information obtained through the External Team Site in a way that would breach an Australian Privacy Principle or otherwise exposes the Commonwealth to a breach of privacy claim.
    4. use External Team Sites to post material, or links to any material, which is defamatory, abusive, obscene, profane, threatening, invasive of a person's privacy, or otherwise in violation of any law.
    5. infringe the Intellectual Property Rights of any third party by posting material on any External Team Site.

Warrant and Indemnity

  1. You acknowledge and agree that:
    1. to the maximum extent permitted by law, you will at all times indemnify, hold harmless and defend the Commonwealth from and against any loss, liability or damage whatsoever that you or your servants or agents may incur arising from or in connection with External Team Sites or any software used to download, install, access or operate an External Team Sites, even where such loss or damage is caused by the negligence of the Commonwealth.
    2. the Commonwealth will not be held responsible for the contents, accuracy, completeness or validity of any information posted on External Team Sites.

Copyright Notice

  1. By posting material to an External Team Site you grant to the Commonwealth and all other users of the External Team Sites a permanent, irrevocable, royalty-free, worldwide, non-exclusive licence (including a right of sub-licence) to use, reproduce, communicate, adapt and exploit the Intellectual Property Rights in the External Team Sites for any purpose.

Interpretation

  1. These Terms and Conditions are to be construed in accordance with the laws of the Australian Capital Territory.
